Debt review and borrowing explained

Debt review can help if your repayments have become unmanageable, but it changes what you can borrow. Here’s what to expect.

What is debt review?

Debt review, sometimes called debt counselling, is a process under the National Credit Act for people who are over-indebted, meaning they can’t keep up with their debt repayments. An NCR-registered debt counsellor assesses your finances and negotiates a single, reduced monthly repayment with your creditors. The arrangement is then usually confirmed by a court or tribunal order.

How it protects you

  • Your creditors can’t take legal action against you for the debts included in the process while you keep to the plan
  • Repayments are restructured into one affordable monthly amount
  • Creditors may agree to lower interest rates or longer terms

Can you borrow while under debt review?

No. Once you apply for debt review, a flag is placed on your credit record, and you can’t take on new credit until the process ends. Registered lenders will see the flag and decline your application.

Be careful of anyone who offers a loan while you’re under debt review. A registered lender can’t do it, so the offer is either from an unregistered lender or a scam.

How long does it last?

It depends on how much you owe and how much you can afford each month. Many plans run for three to five years. When all the debts in the plan have been repaid (except a home loan, which can continue on its normal terms), your debt counsellor issues a clearance certificate and the flag is removed from your record.

Can you leave debt review early?

Before a court order is granted, you may be able to withdraw. After that, the usual ways out are to settle the debts in the plan or, in some cases, apply to court to show you’re no longer over-indebted. Ask your debt counsellor for advice on your specific situation, and be wary of companies charging fees to “remove” you from debt review quickly.

Signs debt review might help

  • You regularly miss repayments or only pay some of your accounts each month
  • You’re borrowing to pay existing debts
  • Your repayments take up most of your income after essential expenses
